"Probate" simply means to prove that a Will is valid. The process, in most cases, is not long, complicated, or expensive. The following is a summary outline of the typical probate process:
Person named Personal Representative in the Will files the Will along with an application requesting that the court appoint him/her personal representative.
Notify heirs and creditors that you have been appointed personal representative and advise them of their rights.
Gather all the property of the person who passed away (referred to as a decedent) and prepare an Inventory & Appraisement of such property.
Notify all heirs and creditors how you propose to distribute the assets of the estate (which is governed by the Will and state law). File all tax returns and distribute the assets of the estate. Notify the court that you have performed your duties and the estate is ready to be closed.
